Overview

Musher respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). We will respond to notices of alleged copyright infringement that comply with the DMCA and applicable law. If you believe that content hosted on the Musher platform infringes your copyright, you may submit a takedown notice as described below.

How to Submit a Takedown Notice

To submit a valid DMCA takedown notice under 17 U.S.C. § 512(c), you must provide the following information in writing:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered
  • Identification of the material that is claimed to be infringing, including sufficient information to locate it on the Platform (such as the bundle name, version, and URL)
  • Your contact information, including name, address, telephone number, and email address
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on their behalf

We will acknowledge receipt of valid notices within 2 business days and process them promptly.

Counter-Notice Procedure

If you believe your content was removed or disabled in error or misidentification, you may file a counter-notice. Your counter-notice must include:

  • Your physical or electronic signature
  • Identification of the material that was removed or disabled and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who submitted the original takedown notice

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we will restore the removed content.

Repeat Infringer Policy

Musher maintains a policy for terminating the accounts of users who are repeat copyright infringers. If an account receives multiple valid DMCA takedown notices, we may suspend or permanently terminate the account at our discretion. We consider the totality of circumstances when determining whether an account qualifies as a repeat infringer.
